Terms of Service

Welcome to ShirtDroid. These Terms of Service ("Terms") are a legal agreement between you and Bright City Labs, LLC, a North Carolina limited liability company doing business as ShirtDroid ("ShirtDroid," "we," "us," or "our"). They govern your use of shirtdroid.com (the "Site") and your purchase of our custom products.

By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Return & Refund Policy, and Shipping Policy. Please read them carefully — they include a limitation of our liability (Section 12) and an arbitration agreement with a class-action waiver (Section 14).

1. Who can use ShirtDroid

You must be at least 18 years old and able to form a binding contract to place an order. By using ShirtDroid, you confirm that you are.

2. What we do

ShirtDroid makes custom, made-to-order products. You upload a photo and a prompt, our system uses artificial intelligence to generate a design, you approve a proof, and we have your product printed and shipped. Each item is created specifically for you based on the design you approve.

3. The content you upload — your license and your promises

You keep ownership of the photo you upload. To make your product, you give us the following.

License to us. You grant ShirtDroid and our service providers (our AI, image-processing, and fulfillment partners) a non-exclusive license to store, process, transform, and reproduce your uploaded content for the purpose of creating, proofing, producing, and delivering your order, and providing support.

Your promises. Each time you upload content, you confirm that:

  • you own it or have all rights and permissions needed to use it;
  • if a person appears in it, you have that person's consent;
  • if a child appears in it, you are the child's parent or legal guardian, or you have the guardian's permission; and
  • the content does not infringe anyone's intellectual property, violate anyone's privacy, or break any law.

4. What you may not upload

You may not upload or ask us to produce content that:

  • you don't have the rights to (including someone else's copyrighted images, trademarks, logos, or brand artwork);
  • depicts a real person without their permission, or a celebrity's likeness without rights;
  • is hateful, harassing, sexually explicit, violent, or otherwise illegal; or
  • infringes any intellectual-property, privacy, or other right.

We can say no. ShirtDroid may refuse, cancel, or refund any order, and remove any content, at our discretion — for example, if we believe it violates these Terms. If you believe content on our Site infringes your copyright, our copyright/DMCA process is described in our Acceptable Use Policy.

5. Orders, proofs, and acceptance

  • Proof approval. Before you pay, we show you a proof of your design. The proof you approve is what we produce — please review it carefully, including spelling and layout.
  • Prices and charges. Prices are shown on the Site. Shipping charges and any applicable sales tax (currently collected in North Carolina) are calculated and shown at checkout before you pay.
  • Payment. Payments are processed by Stripe. We don't see or store your full card number. Placing an order is your offer to buy; your order is accepted when we send your order confirmation.

6. Made-to-order and cancellation

Because every item is custom-made for you, you can cancel for a full refund only before your order enters production. Once production begins, the order can't be canceled or changed because it's already being made just for you.

7. Shipping and returns

Delivery estimates, shipping regions (currently the United States only), and costs are described in our Shipping Policy. Because our products are made to order, returns and refunds work differently than at an ordinary store — please review our Return & Refund Policy, which covers our quality guarantee for defects, print errors, wrong items, and items damaged in transit.

8. Intellectual property

  • Our brand and Site. The ShirtDroid name, logo, Site, and content we create (other than your design) are owned by Bright City Labs, LLC and protected by intellectual-property laws. You may not copy or use them without our permission.
  • Your content. You keep ownership of the photo you upload.
  • Your design. We provide the generated design to you for your own personal, non-commercial use in connection with your order. You're responsible for making sure the content you provide doesn't infringe anyone's rights (see Section 3).

9. Designs are AI-generated

Your design is created by artificial intelligence, so results vary and may not perfectly match what you pictured. That's why we show you a proof before you pay. The product you receive is based on the proof you approve, not on any other expectation — so please make sure the proof looks right before checking out.

10. Disclaimer of warranties

ShirtDroid and our products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Site will be uninterrupted or error-free, or that delivery dates are guaranteed. This section doesn't take away any rights you have under applicable consumer-protection law, and it doesn't limit our quality guarantee in the Return & Refund Policy.

11. Production and delivery by third parties

Our products are produced and shipped by a third-party fulfillment partner, and delivered by third-party carriers. We're not responsible for delays caused by production backlogs, carriers, weather, or other events outside our reasonable control, though we'll help you resolve problems where we can.

12. Limitation of liability

To the fullest extent allowed by law, ShirtDroid and Bright City Labs, LLC will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to an order or these Terms will not exceed the amount you paid for the order giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless ShirtDroid and Bright City Labs, LLC from any claims, damages, losses, and costs (including reasonable legal fees) arising out of the content you upload or your breach of these Terms — for example, a claim that your content infringed someone's rights.

14. Dispute resolution; arbitration and class-action waiver

Please read this section carefully — it affects how disputes are resolved.

Informal resolution first. If you have a problem, contact us through our contact form first and give us a chance to fix it. Most issues can be resolved that way.

Arbitration. If we can't resolve a dispute informally, you and ShirtDroid agree that any dispute relating to these Terms or your order will be resolved by binding individual arbitration, rather than in court, except as noted below. Arbitration uses a neutral arbitrator and is more informal than a lawsuit.

Small-claims carve-out. Either of us may instead bring an individual claim in small-claims court if it qualifies.

Class-action waiver. You and ShirtDroid agree to bring claims only in an individual capacity, and not as a plaintiff or member of any class or representative proceeding.

30-day opt-out. You can opt out of this arbitration agreement by notifying us through our contact form within 30 days of your first order, stating that you opt out. Opting out won't affect any other part of these Terms.

15. Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. To the extent any dispute is not subject to arbitration, it will be brought in the state or federal courts located in North Carolina, and you consent to their jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date above. Changes apply to orders placed after the update; your continued use of ShirtDroid means you accept the revised Terms.
